A California District Court of Appeals has rejected a case involving swine gestation stalls filed by Farm Sanctuary against CorcPork, Inc.
This is the second California court to dismiss this case which the activists say they will pursue to the state Supreme Court. In dismissing the case, the judges cited Proposition 64, which bans private parties from bringing lawsuits against a business unless they were harmed personally and financially by the alleged misconduct.
CorcPork and Clougherty Packing Co. also face an additional lawsuit filed by the Animal Legal Defense Fund and other animal activist groups alleging that the use of gestation stalls violates state law.
